四名假結婚男女涉偽造文件被拘
較早前本局接獲一宗有關假結婚及冒充嬰兒生父以騙取本澳居留權的檢舉。
經調查,本局發現於2001年何姓內地男子與其余姓內地妻子於本澳逾期逗留期間誕下一名男嬰,並安排林姓本澳男子冒認為男嬰之生父,以協助男嬰取得本澳居留權。至2010年5月,何姓內地男子與其余姓內地妻子於內地離婚,二人於同年年底分別與徐姓本澳女子及假冒男嬰生父之林姓男子結婚,並以家庭團聚為由分別申請何姓內地男子及其內地的另一兒子,以及余姓內地女子來澳,先後取得澳門非永久居民身份證。
何姓男子承認向徐姓本澳女子支付兩萬澳門元以進行假結婚,余姓女子承認與林姓本澳男子假結婚並以家庭團聚為由申請來澳定居及取得澳門居民身份證,而徐姓本澳女子及林姓本澳男子則否認作案,惟根據調查所得,有強烈跡象顯示四人藉假結婚騙取澳門居民身份。本局根據第6/2004號法律《非法入境、非法逗留及驅逐出境的法律》第18條第二款的規定,以偽造文件罪將四名涉案男女移送檢察院偵辦。
Four persons engaged in fake marriage arrested for document forgery
Earlier on, the Judiciary Police received a report regarding fake marriage and impersonating the biological father of an infant in order to acquire the right of abode in Macao fraudulently.
After investigation, the Judiciary Police found out that the mainland wife surnamed Yu of a mainland man surnamed Ho gave birth to their baby boy while they were overstaying in Macao in 2001. They arranged a Macao man surnamed Lam to impersonate the biological father of the baby boy, so as to assist the baby to acquire the right of abode in Macao. Until May 2010, the mainland man surnamed Ho and his wife surnamed Yu got divorced in the mainland, and they married a Macao woman surnamed Chui and the man surnamed Yu who impersonated the biological father of the baby boy respectively towards the end of the same year. Applications were made for the mainland man surnamed Ho and his another son in the mainland, as well as the mainland woman surnamed Yu to come to Macao on the ground of family reunion respectively, whereby the Macao Non-permanent Resident Identity Cards were acquired successively.
The man surnamed Ho confessed to have paid the Macao woman surnamed Chui MOP20,000 to engage in a fake marriage, and the woman surnamed Yu confessed to have a fake marriage with the Macao man surnamed Lam, then applied to come to reside in Macao on the ground of family reunion and obtained the Macao Resident Identity Card. However, the Macao woman surnamed Chui and the Macao man surnamed Lam denied committing the crime. Nevertheless, based on the investigation result, there are strong indications that the four of them have engaged in fake marriage to obtain the identity of Macao residents fraudulently. Based on the stipulation as stated in Paragraph 2 of Article 18 of Law No. 6/2004 “Law of Illegal Immigration, Illegal Stay and Deportation”, the Judiciary Police transferred the four involved persons to the Public Prosecutions Office with the offence of document forgery.

A PJ recebeu uma queixa que indicava um caso de susposto casamento falso no qual alguém fingia ser o pai biológico de um bebe para adquirir a autorização de residência em Macau.
Na investigação, apurou-se que um homem da RPC, de apelido Ho, e a sua esposa proveniente também da RPC, de apelido Yu, deu à luz um bebe em Macau, em 2001, durante o período em que ambos tinham ultrapassado o prazo de permanência em Macau. Para além disso, um outro homem de apelido Lam, residente de Macau, foi declarado como pai biológico do rapaz para que este pudesse obter a autorização de residência em Macau. Em Maio de 2010, o casal divorciou-se na China continental, e no fim do mesmo ano, o marido, Ho, casou com uma residente de Macau, de apelido Chui, e a ex mulher, Yu, casou com o homem que fingiu ser o pai do bebe, de apelido Lam. Posteriormente, o Ho e um seu outro filho na China continental, bem como a senhora Yu conseguiram vir para Macau com o fundamento da junção familiar, e todos acabaram por obter a autorização de residência em Macau.
O Ho, confessou ter pago 20.000 MOP à Senhora Chui, residente de Macau, como remuneração para o casamento falso, e a Yu também admitiu, através do casamento falso, ter requerido a autorização de residência em Macau com base na junção familiar e que lhe permitiu obter o BIR de Macau. Todavia, os dois residentes de Macau, a Chui, e o Lam negaram o crime. Na investigação provou-se que existem fortes indícios que as quatro pessoas efectuaram os casamentos falsos para a aquisição da autorização de residência em Macau. Os quatro detidos foram presentes ao MP pelo crime de falsificação de documento conforme o estipulado no n.º 2 do artigo 18.º da Lei n.º 6/2004 - Lei da Imigração Ilegal e da Expulsão.
