五男女涉貨物詐騙就逮
2020年7月21日,一名內地女子向本局報稱遭一名內地男子串謀筷子基區某珠寶店藉協助其向本澳銀行申請巨額貸款,誘騙其以高價購買珠寶首飾,損失合共13,000元人民幣。
經調查,事主於2019年12月透過手機交友平台認識該名內地男子,誤信對方聲稱在涉案珠寶店購買首飾有助獲得本澳兩間銀行批出巨額貸款,遂於2020年3月10日在該珠寶店選購一件價值7,000元人民幣的首飾,並將單據及委托貸款授權書交給店內職員轉交涉案男子來申請銀行貸款。事主於4月中旬接獲涉案男子通知有關貸款已獲批核,並收到銀行批核的網絡截圖,但由於疫情關係而無法來澳取款,復於7月上旬得悉有關貸款審批已過期,需再次購物才能提取貸款,事主不虞有詐,於7月20日在珠寶店購入6,800澳門元的首飾並將單據發送給涉案男子,隨後涉案男子失去聯絡,事主向相關銀行查知並無批出任何貸款,恍然被騙。
本局經對涉案兩件首飾進行鑑定,證實為約值400及50澳門元的劣質飾物,而銀行亦確認有關網絡截圖為偽造;同時從消費者委員會獲悉涉及該珠寶店出售假貨物的投訴個案共17宗。本局獲得司法官批示,於2020年7月22日搜查涉案珠寶店兩間分店,搜獲數千件劣質金飾、大量委托貸款授權書及數萬港元現金,並將珠寶店負責人夫婦及三名店員帶返調查。
涉案負責人夫婦否認犯罪,但有職員供出上述授權書由一名在逃女店員提供,但對方從未協助過客人申請貸款,且以廉價首飾充當貴價首飾來詐騙客人。本局綜合調查所得,有強烈跡象顯示珠寶店負責人及一眾職員串謀詐騙,故以犯罪集團罪、貨物欺詐罪及電腦偽造罪將五名涉案男女移送檢察院偵辦,並透過內地警方協助緝捕其餘在逃人士。
Five individuals apprehended for fraud of goods
On 21st July 2020, a mainland woman reported to the Judiciary Police that a mainland man had conspired with a jewellery shop in the Fai Chi Kei district to lure her into purchasing jewellery at high price on the pretext of assisting her in applying for loan of massive amount in local banks, incurring a total loss of RMB13,000.
Investigation revealed that the victim had got acquainted with the mainland man via mobile social application in December 2019 and falsely believed him in claiming that purchasing jewellery in the involved jewellery shop could assist her in securing loans of massive amount from 2 local banks. She thus purchased a piece of jewellery worth RMB7,000 in the jewellery shop on 10th March 2020, giving the receipt and an authorization letter for entrusted loan to the involved man through the staff of the shop for loan application from the bank. In mid-April, the victim was notified by the involved man that relevant loan had been approved and she received online screenshot of the bank approval. However, the pandemic forbade her from coming to Macao to get the money. Having learned subsequently that the approval of the loan had expired in early July, and that further purchase had to be made to enable the drawdown of the loan, the unsuspecting victim bought a piece of jewellery worth MOP6,800 in the jewellery shop on July 20th and sent the receipt to the involved man, who was out of contact subsequently. It was not until she checked with the involved bank that no loan had ever been approved did she realize that she had been defrauded.
The Judiciary Police conducted examination on the two pieces of jewellery, confirming that they were substandard accessories worth approximately MOP400 and 50. The bank also confirmed that the involved online screenshot was forged. Meanwhile, it was learned from the Consumer Council that there were 17 complaint cases involving sales of counterfeit merchandises against the jewellery shop. With the dispatch of the judicial magistrate, the Judiciary Police searched the two branches of the involved jewellery shop on 22nd July 2020, seizing thousands of substandard gold accessories, a large number of authorization letters for entrusted loan and cash of tens of thousands of Hong Kong dollars, and bringing the couple in charge of the jewellery shop and 3 shop attendants back for investigation.
The involved couple-in-charge denied the perpetration, yet a staffer confessed that the abovementioned authorization letter was provided by a female shop attendant at large, who had never assisted the customers in loan applications and defrauded them with inexpensive accessories disguised as expensive ones. Having consolidated results of investigation, the Judiciary Police found compelling indications that the persons-in-charge of the jewellery shop had conspired with the staff to defraud others, and thus transferred the 5 involved individuals to the Public Prosecutions Office for offences of criminal syndicate, fraud of goods and computer forgery, while pursuing the individuals at large via the assistance of the mainland police.

Em 21 de Julho de 2020, a PJ recebeu a queixa de uma mulher da RPC, na qual alegava que um homem, também da RPC, que estava em conluio com uma joalharia do Bairro Fai Chi Kei, a pretexto de ajudar a vítima no requerimento de empréstimo de valor elevado nos bancos de Macau, acabou por a convencer a comprar jóias falsas por um preço elevado sofrendo então um prejuízo de 13.000 RMB.
Na investigação, apurou-se que a vítima, em Dezembro de 2019, numa plataforma de média social, conheceu o envolvido que disse que fazia compras na referida joalharia e que a podia ajudar na obtenção de um empréstimo de valor elevado em dois bancos de Macau. Ela então, em 10 de Março de 2020, comprou uma jóia no valor de 7.000 RMB na dita joalharia, apresentou logo a uma empregada da joalharia o respectivo recibo e uma procuração para empréstimo para que os entregasse ao homem. Em meados de Abril, ela foi informada de que tinha sido aprovado o empréstimo e recebeu o screenshot sobre a aprovação de banco, mas não conseguiu vir a Macau para levantar o dinheiro por causa de pandemia. No início de Julho, ela veio a ser informada de que a aprovação expirou, precisava de fazer compras outra vez. Ela acreditou e comprou, em 20 de Julho, outra peça no valor de 6.800 MOP na dita joalharia e enviou o recibo para o homem. A partir daí não conseguiu mais contactar com o homem, veio também a saber que não havia qualquer pedido de empréstimo no banco, percebeu assim de ter sido burlada.
A PJ verificou, após verificar as duas jóias, que são acessórios de má qualidade que valem cerca de 400 e 50 patacas respectivamente, por outro lado, o banco confirmou ser um screenshot falso. Para além disso, a PJ obteve informações através do Conselho de Consumidores de que a dita joalharia esteve envolvida em 17 queixas ligadas à venda de produtos falsos. Mediante despacho do magistrado, a PJ efectuou buscas, em 22 de Julho de 2020, nos dois subsidiários da joalharia em causa e foram apreendidos vários milhares de acessórios de má qualidade, grande quantidade de procurações para fazer empréstimos e numerário num valor de dezenas de milhares de HKD. O casal responsável da joalharia e três suas empregadas foram levados para investigação.
O casal negou o crime mas uma empregada revelou que os documentos de procuração tinham sido fornecidos por uma outra colega que tinha fugido, e que nunca ajudou os clientes a pedir empréstimos e burlou-os usando jóias falsas. Após análise integrada, houve indícios fortes que indicam que os responsáveis da joalharia e as empregadas estavam em conluio para praticar as burlas, os cinco detidos foram presentes ao MP por associação criminosa, fraude mercantil e falsificação informática, a PJ vai continuar à procura da pessoa envolvida em fuga com o apoio das autoridades policiais do continente.
